Each rate is charged only on its own slice of the price, not on the whole of it. The 8% flat rate applies to non-citizens and foreign companies buying residential property, for instruments executed from 1 January 2026; permanent residents pay the tiered rates. The loan agreement is stamped separately at 0.5% of the loan.

When each of these is paid

Not all at once — which is the part most first-time buyers are caught out by.

  1. Booking fee — 2% to 3% of the price, usually before anything is signed.
  2. SPA legal fee + transfer duty — Within a few weeks of signing, when your solicitor stamps the documents.
  3. Loan legal fee + loan duty — With the loan documents, after you accept the bank's letter of offer.
  4. Balance of the down payment — In one payment on a completed unit. On a project under construction it is drawn in stages as the building goes up.

On a new launch the transfer may not be stamped until the building is finished and the title issued — sometimes years after you sign. On a completed unit or a subsale, everything above lands inside three months.

Common questions

How much are legal fees and stamp duty in Malaysia?
Between about 5% and 6% of the purchase price for a financed purchase, which is where the great majority land. On a RM700,000 home with a 90% loan, that is roughly RM37,000 once the SPA legal fee, the loan legal fee, service tax on both, stamp duty on the transfer, stamp duty on the loan and disbursements are added together. The share creeps up as the price rises rather than down, because stamp duty on the transfer steps up through its tiers. Buying a new launch from a developer brings the legal fees below this, because they are charged on a discounted scale.
What is the legal fee scale in Malaysia?
The Solicitors' Remuneration Order 2023 sets it: 1.25% on the first RM500,000, 1% on the next RM7,000,000, and a negotiated rate not exceeding 1% on anything above RM7.5 million, with a minimum fee of RM500. The same scale is charged twice on a financed purchase — once on the sale and purchase agreement, once on the loan agreement and charge — because they are two separate pieces of work.
Is the legal fee cheaper when I buy from a developer?
Yes. A sale governed by the Housing Development (Control and Licensing) Act 1966 — which covers new launches — is charged on a discounted scale: 75% of the full fee up to RM250,000, 70% up to RM500,000, 65% up to RM1 million, and 60% above that on the sale side. The loan side gets the same discounts, dropping to 50% above RM1 million. A solicitor may not discount that scale any further, though they may take up to 25% off the full scale on a subsale. The calculator above quotes the full scale, so on a new launch your legal fees come in below the figure it gives you.
Do first-time buyers pay stamp duty?
No, not on a home up to RM500,000. A Malaysian citizen buying their first residential property pays no stamp duty on the transfer and none on the loan agreement, on a sale and purchase agreement signed by 31 December 2027. You must never have owned residential property before, including anything inherited or received as a gift, and any co-purchaser must qualify too. There is no partial relief above the cap: at RM500,001 the full duty applies.
How much stamp duty does a foreigner pay?
A flat 8% of the price on the transfer, for instruments executed from 1 January 2026 — up from 4% before that. It applies to non-citizens and foreign companies buying residential property. Malaysian permanent residents are not caught by it and pay the same tiered rates as citizens, though they cannot claim the first home exemption. The loan agreement is stamped at 0.5% for everyone.
Is service tax charged on legal fees?
Yes, 8% on the solicitor's professional fee. It is not charged on stamp duty or on disbursements, which are a government charge and an out-of-pocket cost rather than a service the firm is selling you.
What are disbursements?
The costs a firm pays out on your behalf and passes on: land searches, bankruptcy searches, the stamping itself, registration at the land office, and courier. This calculator allows RM1,000 on the purchase and RM1,000 on the loan, which is a fair working estimate. A firm's own quotation will differ by a few hundred ringgit either way.
Does the calculator include everything I have to pay?
No — it covers the legal and stamping side, which is the part that follows published rates. It does not include the booking fee, the bank's valuation and processing fees, MRTA or MLTA insurance, fire insurance, or anything you spend on the home after you get the keys.
